Bridgeway Community Health Terms and Conditions for Employee Use of Company SMS Messaging

Purpose This document outlines the terms and conditions for employees of Bridgeway Community Health (“the Company”) in their use of Company SMS messaging. These rules are established to ensure compliance with The Campaign Registry (TCR) rules, maintain professional communication standards, and protect client rights.

1. Authorized Usage

1.1 Company SMS messaging is provided to employees for business purposes only. Examples include:

  • Individual client communication.
  • Coordination with colleagues regarding client care.

1.2 The following uses of Company SMS messaging are strictly prohibited:

  • Mass messaging or bulk SMS campaigns.
  • Sending appointment reminders.
  • Any communication that violates TCR or other regulatory requirements.

2. Client Consent and Opt-Out Requirements

2.1 All SMS communications with clients must:

  • Be initiated only after obtaining the client’s explicit consent.
  • Include a clear and simple method for clients to opt out of future SMS messages (e.g., “Reply STOP to opt out”).

2.2 Employees must respect client opt-out requests immediately. Messages must cease upon receiving an opt-out instruction.

3. Professional Standards

3.1 All SMS communications must:

  • Be professional and respectful in tone.
  • Avoid sensitive information that could breach client confidentiality or violate HIPAA/42 CFR Part 2 regulations.
  • Be free from promotional or marketing language unless expressly permitted by the Company.

4. Monitoring and Compliance

4.1 Bridgeway Community Health reserves the right to monitor SMS communications to ensure compliance with these Terms and Conditions and TCR rules.

4.2 Non-compliance with this policy, including failure to adhere to TCR rules or client opt-out requests, may result in disciplinary action, up to and including termination of employment.

5. Security and Confidentiality

5.1 Employees must safeguard any device used for Company SMS messaging and ensure it is protected by appropriate security measures (e.g., password protection).

5.2 Messages containing sensitive information must not be sent via SMS unless pre-approved and encrypted per Company policies.

6. Violations and Reporting

6.1 Employees who suspect any violation of this policy must report it immediately to their supervisor or the Compliance Department.

Acknowledgment

By using Company SMS messaging, employees acknowledge and agree to abide by the terms outlined in this document. Employees further acknowledge their responsibility to maintain compliance with all applicable regulations and Company policies.
